"Legal Protection of Trademarks in the EAEU"
The conference was attended by legal scholars from Russia, Armenia, Kazakhstan and Belarus.
The conference was organized by IP CLUB, the Association of Lawyers on Intellectual Property of Armenia and the Law School "Statute."
Within the framework of the event, general issues of the practice of considering disputes over trademarks in the countries of the Eurasian Economic Union, features of the legal nature and legal regulation of the Eurasian trademark were discussed. A separate session was devoted to the prospects for the development of alternative ways of resolving disputes in the field of trademarks.
Representatives of the legal community of all countries that are members of the Eurasian Economic Union spoke at the conference.
Within the framework of the first session "General problems of the practice of considering disputes over trademarks in the EAEU countries" were: A.A. Robinov - Ph.D., Deputy Chairman of the Intellectual Property Council of the Chamber of Commerce and Industry of the Russian Federation; Yu.A. Bolotov - Ph.D., Doctor of Sciences, Fairfax University, Louisiana, USA, Managing Partner of Bolotov and Partners LLP (Republic of Kazakhstan); A.M. Davtyan - Chairman of the Association of IP Lawyers of Armenia, Master of Law of the Russian-Armenian University (Republic of Armenia) and A.A. Bogustov - Ph.D., Associate Professor, Department of International Law, Yanka Kupala Grodno State University (Republic of Belarus).
As part of their speeches, the speakers noted the general trend of an increase in the number of trademark applications. Similar features of the legal regulation of relations over trademarks were revealed. At the same time, each speech focused on the current problems of dispute resolution in the field of trademarks. At the same time, each speaker paid special attention to the specifics of such disputes in the countries represented.
Within the framework of the second session "Features of the Eurasian trademark" spoke: A.B. Abenova - head of the department of industrial samples of the examination department of the Eurasian Patent Office of the Eurasian Patent Organization; B.A. Shakhnazarov - D.Sc., Associate Professor, Department of Intellectual Rights, O.E. Kutafina Moscow State Law University (MGUA) and R.I. Khusainov - L.L.M, patent attorney, managing partner of Khusainov, Khomyakov and Partners.
The session was devoted not only to the prospects for the formation of a regional trademark system, but also to the already successful regional registration system of industrial designs, not only the features of the regional trademark system were voiced, but also the differences between the regional system and the Madrid trademark system were clearly demonstrated.
The third session "Prospects for the development of alternative ways of resolving disputes with the field of trademarks" brought together three leading specialists of the Russian Federation on alternative dispute resolution. The session was attended by: E.G. Avakyan - Vice-President of the Federal Chamber of Lawyers of the Russian Federation, Chairman of the Association for Disputes in the Field of Intellectual Property of the Arbitration Center at the Russian Union of Industrialists and Entrepreneurs, adviser to AB "Egorov, Puginsky, Afanasyev and Partners"; L.L. Arzumanova - D.Sc., Professor, Department of Financial Law, Moscow State Law University named after O.E. Kutafina (MGUA), Mediator of the Center for Mediation at the Russian Union of Industrialists and Entrepreneurs of the Russian Federation, Chairman of the Commission on Financial Legislation at the Moscow Branch of the Russian Bar Association. The session was moderated by M.A. Rozhkova, Ph.D., President of IP CLUB, member of the Expert Council of the State Duma Committee on Information Policy, Information Technology and Communications, arbitrator of the Board of Disputes in the Field of Intellectual Property and the Board of Disputes in the Field of Digital Economy of the Arbitration Center at the Russian Union of Industrialists and Entrepreneurs of the Russian Federation.
Within the framework of the session, a lively and vivid discussion of topical issues of mediation in disputes about trademarks, as well as acute issues of arbitrariness, took place.
The format of the conference made it possible to express their positions not only to the speakers, the conference participants had the opportunity to ask questions to the speakers and get answers to them.
